Event Release

By attending an Event (as defined herein), you agree to the terms of this Event Release (“Release”) with Dovetail Research Pty. Ltd., its affiliates, successors, and assigns (collectively, “Dovetail”).

  1. You hereby grant to Dovetail the unlimited right and permission to, and to authorize third parties to, use your name, image, likeness, voice, title and other information, and any material based thereon or derived therefrom, together with any other material, in any manner and any venues and media, whether now known or hereafter devised, anywhere in the world in perpetuity, for any lawful purpose, including without limitation for marketing and promotional purposes.

  2. You shall have no right of approval, no right to attribution, and no claim (including without limitation, claims based upon invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, editing, reproduction, or use of any composite form of your name, picture, likeness, voice, or biographical information. You acknowledge that nothing herein will obligate Dovetail to use your name, likeness, or any photographic, video, or audio recording of you or statement made by you.

  3. All statements, photographs, and/or audio or video recordings taken of you by Dovetail shall be the sole property of Dovetail. You shall not receive any payment, residuals, reuse fees, or other compensation in connection with use of these statements, photographs, and/or audio or video recordings for promotional, commercial, or other purposes. You hereby release, waive, forever discharge, and agree to hold harmless and defend Dovetail and its legal representatives and assigns, and all persons acting under its permission or authority from: (a) any claims of any kind or nature (including without limitation, claims based upon invasion of privacy, defamation, or right of publicity) arising out of or relating to the use of the statements, photographs, audio or video recordings, or use of any composite form of your name, picture, likeness, voice, or information against Dovetail or any person or firm authorized by Dovetail to publish said materials; (b) any liability for what might be deemed to be misrepresentation or defamation of you, your character or your person, as applicable, due to any use, modification, distortion, or otherwise faulty or altered reproduction of your voice; and (c) any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury that may be sustained or caused by you, or by any property belonging to you while participating in any Dovetail affiliated events (each an “Event”), or while in, on or upon the premises where the Event is being conducted or in transportation to and from said premises.

  4. By registering for and attending a sponsored Event (e.g., Insight Out), you consent for Dovetail to share information collected about you (e.g., your name, email, title) with Event sponsor(s).

  5. If you are a resident of California then you hereby waive California Civil Code Section 1542 in connection with the foregoing, which states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

  6. You understand that Dovetail is relying on this Release and will incur significant expense in reliance on this Release, and you agree that this Release cannot be terminated, rescinded, or modified, in whole or in part. You waive your right to injunctive and other equitable relief in the event of a dispute with Dovetail. You will not have the right to enjoin or interfere with the production, distribution, exploitation, advertising, or promotion of any statements, photographs, and/or audio or video recordings taken of you.

  7. You represent that you are at least eighteen (18) years of age and have the full and exclusive right and authority to agree to the terms of this Release and to grant the rights granted hereunder. This agreement shall be governed by the laws of the State of California, and any controversies or disputes arising out of or relating to this agreement shall be resolved exclusively in the courts located in San Francisco County.
